General Terms & Conditions
Whereas KASIKORNBANK PCL (“KBank”), as an e-wallet service provider, and You Technologies Group (Thailand) Co., Ltd. (the “Operator”), as the YouTrip application service provider, have entered into a co-branded partnership in order to provide services for currency exchange and payment for goods/services via an e-wallet, YouTrip Powered by KBank, or any other names to be prescribed by KBank as KBank deems appropriate (the “YouTrip Service”), and the User wishes to use the YouTrip Service as approved by KBank and per the details determined by KBank, the User hereby agrees to be bound by and comply with the terms and conditions of this service (the “Conditions for Use of the Service”).
- General Terms and Conditions
- KBank provides the YouTrip Service to persons 15 years of age or older, of Thai nationality, or per the qualifications to be changed and announced by KBank.
- The YouTrip Service refers to a prepaid card which can accommodate multi-currency payment in the YouTrip Wallet (the “YouTrip Wallet”). The User shall download the YouTrip application from App Store or Play Store and register for the service per the method and procedure determined by KBank for use with YouTrip Card obtained from KBank (the “YouTrip Card”). The YouTrip Card is a prepaid MasterCard card which allows the User to convert currencies in the YouTrip Wallet available via the YouTrip application which the User has registered for. The registration for the YouTrip Card shall be valid only when the User has linked the YouTrip Card to the YouTrip Wallet in the YouTrip application and has successfully passed verification and authentication processes in accordance with the criteria and conditions specified by KBank.
- Unless otherwise notified or stated, new features which are to be added, revised or corrected in the service shall be subject to the Conditions for Use of the Service.
- Use of Service
- Use of Funds Transfer Tool
The “Funds Transfer Tool” includes the PIN and/or One-Time Password (OTP) and/or Password and/or the YouTrip Card and/or other tool(s) that the User uses for logging in to the YouTrip application to use the service per the Conditions for Use of the Service and/or for confirming the use of services and/or for use of the YouTrip Card and/or as an instrument for using the YouTrip Service via equipment/channels determined by KBank.- After being approved to use the YouTrip Service, the User shall (1) receive/set the PIN per the steps specified in the YouTrip application for logging in to the YouTrip application; and (2) set the PIN per the steps specified in the YouTrip application for withdrawal via ATM in other countries, or for payment of goods/services via Electronic Data Capture (EDC) which accommodates PIN. The User shall enter the PIN every time when using the YouTrip Card with an ATM or EDC that accommodates PIN.
- The User shall safeguard the Funds Transfer Tool and must keep it confidential. Disclosure of the Funds Transfer Tool is regarded as non-compliance with the Conditions for Use of the Service. The User shall be responsible for any loss incurred from such disclosure or any actions which have allowed the third party to know of and use the Funds Transfer Tool. The User can change the PIN on their own at any time, in accordance with the steps specified in the YouTrip application, without giving notification to KBank and/or the Operator.
- In case the Funds Transfer Tool is lost/stolen, the User may contact the Operator at the YouTrip Contact Center, Tel. 02-026-3812, or any telephone number which the Operator may change in the future (if any) (the “YouTrip Contact Center Number”), available 24 hours a day. If the Funds Transfer Tool is invalidated/forgotten, the User can request a new one through the YouTrip application by following the steps specified in the YouTrip application.
- The User agrees that any actions performed, including but not limited to acceptance of/ amendment to/change to/addition to the Conditions for Use of the Service/services/fees of the YouTrip Service, by KBank and/or the Operator and/or any person/juristic person, regardless of whether said actions were undertaken by the User or by another person, in any event, with the use of the Funds Transfer Tool, are complete and valid, and shall be binding upon the User as if they were undertaken by the User themself; and it shall be deemed executed by the User by way of electronic signature as evidence given to KBank and/or the Operator for the transaction, which is complete and valid from the time the transaction is confirmed, and which the User shall in no event cancel or change. The User also agrees to authorize KBank and/or the Operator to treat the transaction data as an original document which can be, in all respects, used as proof of the transaction for legal purposes. The User agrees and acknowledges to assume the risks related to the use of electronic services which allow the User to conduct transactions by themself and require no additional documents or evidence for confirmation and/or delivery to KBank and/or the Operator, unless otherwise stated by KBank and/or the Operator. The User shall check the balance every time a transaction has been conducted.
- After the User has applied for the service, the value of the User’s YouTrip Wallet linked to the YouTrip Service (“the User’s YouTrip Wallet”) shall be automatically set at 0 (zero) Baht; 1 (one) e-wallet can be linked to 1 (one) mobile phone number and 1 (one) national ID card number. The User’s YouTrip Wallet shall be used for payment for goods/services, including any other services related to the YouTrip Service which shall be added or changed by KBank in the future.
- Top up of/money transfer to the YouTrip Wallet
- The User shall top up/transfer funds to the YouTrip Wallet by themself, or accept funds transfer from a third party, via KBank’s K PLUS or via other channels determined by KBank, provided that the relevant service/channel can accommodate the operation at a given period in accordance with the procedures prescribed by KBank.
- The User shall top up/transfer funds to the User’s YouTrip Wallet in Thai Baht every time (unless there is a change made by KBank in the future), and the amount per transaction must not be less than that to be determined, or changed, by KBank. The total amount must not exceed the limit determined by KBank. The User may check the top up/funds transfer limit of the User’s YouTrip Wallet via the YouTrip application and KBank’s website.
- Payment for goods/services via the YouTrip Wallet
The User may use the YouTrip Card for payment for goods/services via EDC or online payment system in Thailand or other countries, which accommodates a card issued under the MasterCard network. The User agrees to authorize KBank to deduct the amount specified by the User together with fee (if any) from the User’s YouTrip Wallet according to the procedures of the payment accepting machine/system; the deduction per the procedure of the payment accepting machine/system shall be regarded as correct and fully binding upon the User without any consent or additional documentation to be given by the User to KBank. - Cash withdrawal from the YouTrip Wallet
- The User may make cash withdrawal from the User’s YouTrip Wallet with the use of the YouTrip Card for cash withdrawal via ATMs available in other countries which accommodate the services available under the MasterCard network. The User shall pay cash withdrawal fee at the rate determined by KBank and the ATM provider; the fee may be subject to change, and KBank will announce the change (if any) from time to time.
- The amount withdrawn via ATM abroad will immediately be deducted from the User’s YouTrip Wallet.
- The cash withdrawal amount in foreign currency of the relevant country shall not exceed the limit determined by KBank and the ATM provider.
- Funds transfer from the YouTrip Wallet
The User may make funds transfer from the User’s YouTrip Wallet to the User’s deposit account held with KBank only in accordance with the steps specified by KBank. The User may make a funds transfer transaction within the amount available in the User’s YouTrip Wallet, with no limit to the number of daily transactions, which KBank reserves the right to change at any time.
KBank shall deduct the amount specified by the User together with fee (if any) from the User’s YouTrip Wallet, and the amount shall be credited into the User’s deposit account after the transaction made by the User has been approved within the period determined by KBank. - Currency exchange in the YouTrip Wallet
- The User may exchange any currency available in the User’s YouTrip Wallet for other currencies which the system of the YouTrip Service can support in a given period (“the Supported Currency”) by conducting foreign currency purchase/sales transactions in the YouTrip application by themselves with the main objective of foreign currency spending whether for online payment of goods/services or expenses on traveling abroad, provided that the User may only conduct not more than an aggregate of 20 (twenty) currency exchanges per day through the User’s YouTrip Wallet.
- The amount for purchase/sale of foreign currency via the YouTrip application shall neither be less than nor exceed the minimum or maximum limit (as the case may be) per transaction for each currency as determined and announced by KBank or allowed by the YouTrip Service system within a given period.
- The User agrees to pay a fee for every foreign currency purchase/sale transaction made via the YouTrip application to KBank (if any) at the rate determined or changed via announcement of KBank.
- KBank shall specify and notify all exchange rates in the YouTrip application via the Operator, and the exchange rates shown in the YouTrip application may be changed at any time. The User shall check the exchange rate every time before making related transactions via the YouTrip application.
- The exchange rate shown in the YouTrip application is only the indicative rate in a given period; KBank is not always bound to apply the said exchange rate to a foreign currency transaction for the User. Each time the User is notified by KBank (via the Operator) of the exchange rate while converting a currency via the YouTrip application, the User shall be allowed, within a specific period of time, to choose whether or not the User shall use the said rate for the foreign exchange purchase/sales transaction with KBank (via the Operator). If the User does not confirm a foreign currency purchase/sale transaction with KBank (via the Operator) within the period specified by KBank (via the Operator), KBank (via the Operator) may immediately change the exchange rate as reference for foreign currency transactions to be conducted by the User. The User agrees and accepts that the User has no right to claim from KBank any damage that may be incurred from the failure of the User to conduct a foreign currency purchase/sale transaction at the rate notified by KBank (via the Operator) within the said period.
KBank (via the Operator) reserves the right to determine the period within which the User is required to use the reference rate for purchase/sale of foreign currency without prior notice. - Each foreign currency purchase/sale transaction conducted via the YouTrip application shall be valid only after the User has been notified by the Operator of the successful transaction.
- If KBank has found that, or there is a reason to believe that, any Market Disruption Event (per the definition below) has occurred, the User acknowledges and agrees that KBank and/or the Operator may immediately take the following actions, whether in whole or in part, as KBank deems appropriate, even if KBank has not yet announced the Market Disruption Event to the general public, and the User shall not sue KBank and/or the Operator or demand that KBank and/or the Operator be liable for any damage/loss that may be incurred from the said action:
– To cease the foreign currency transaction service provided in the YouTrip application.
– To reject the request for foreign currency transaction submitted by the User via the YouTrip application, wherein the Operator has not yet given notice of the transaction result.
– To cancel the foreign currency transaction conducted by the User during the Market Disruption Event, and notice of the successful transaction has been sent by the Operator (only for the cases where the exchange rate indicated in the YouTrip application during the said Market Disruption Event is significantly different from the market rate). The User agrees to authorize KBank and/or the Operator to correct/recall the full amount the User has received under the said transaction, from the User.The “Market Disruption Event” means any action, event or situation, where KBank, at its sole discretion, deems that:
(a) it may, directly or indirectly, hinder, limit or inhibit the ability of KBank or other member banks to receive the fixed quotation of the offered price, to exchange any currency for other currencies, or to transfer any amount to other countries or within the same country; or
(b) it may cause the purchased currency to be unavailable in the interbank foreign exchange market per the normal trade procedures; or
(c) it may cause unusual price fluctuation in the foreign exchange market. - Smart Exchange function
If the User makes payment for goods, services, fees or other expenses abroad, or withdraws cash via an ATM abroad, with the User’s YouTrip Wallet, the amount deducted will be based on the currency that the goods/services are priced in, or the home currency of the country where the relevant ATM is located (the “Transaction Currency”). If there are insufficient funds in the Transaction Currency available in the User’s YouTrip Wallet, the system will automatically exchange currencies available in the User’s YouTrip Wallet per the sequence of currency below for the Transaction Currency (provided that the system can accommodate the operation in a given period) until the Transaction Currency in the User’s YouTrip Wallet is sufficient for such a transaction, based on the foreign exchange rate of the Transaction Currency determined by KBank as of the transaction date and time as shown in the YouTrip Service, wherein the foreign exchange rate may not be equal to that at which the User conducts the foreign exchange transaction, by themself (the “Automatic Currency Exchange”), and shall be under the following conditions:
– If the Transaction Currency is Thai Baht, the system will always conduct the Automatic Currency Exchange.
– If the Transaction Currency is the Supported Currency but not Thai Baht, the system will conduct the Automatic Currency Exchange only if there is Thai Baht available in the User’s YouTrip Wallet.
– If the Transaction Currency is not the Supported Currency, the system may convert the Transaction Currency to Thai Baht of equivalent amount before conducting the Automatic Currency Exchange.The sequence for exchange of the Supported Currency under the Smart Exchange function is as follows:
1) Thai Baht (THB)
2) US Dollar (USD)
3) Euro (EUR)
4) Japanese Yen (JPY)
5) Great Britain Pound (GBP)
6) Hong Kong Dollar (HKD)
7) Singapore Dollar (SGD)
8) Australian Dollar (AUD)
9) Swiss Franc (CHF)
10) Canadian Dollar (CAD)
- The User acknowledges and agrees that if the balance in the User’s YouTrip Wallet while conducting any transaction is insufficient for the deduction necessary for settling the transaction and paying fees or any expenses related to the transaction (if any), the User shall not be able to conduct that transaction.
- The User accepts that the User has no right to receive any interest or compensation on the balance available in the User’s YouTrip Wallet, unless otherwise considered and determined by KBank.
- The User may view historical transaction data and evidence via the YouTrip application system; the User may receive transaction evidence via various channels determined by KBank.
“Transaction Evidence” means evidential documents such as transaction record, payment/transfer notification, statement and any other evidence related to transactions under the YouTrip Service per the details determined by KBank. - If KBank finds that there has been no change of the amount in the User’s YouTrip Wallet within the period specified by KBank from the latest use of the service, and the balance in the User’s YouTrip Wallet is less than the minimum required by KBank, the User agrees to pay a maintenance fee for the YouTrip Wallet per the rate in accordance with the criteria and conditions prescribed by KBank (if any), and to authorize KBank to take any actions as KBank deems appropriate, including the cancellation of the service or the cancellation of the User’s YouTrip Wallet, under relevant criteria or laws.
- Use of Funds Transfer Tool
- Duties and Responsibilities
- The User agrees and accepts that, other than via the K PLUS service of KBank, the use of the service in accordance with the Conditions for Use of the Service can be made via the Funds Transfer Tool of the Operator. If there is any problem or error regarding the use of the Funds Transfer Tool of the Operator, or any damage occurs from the use of the Funds Transfer Tool of the Operator, the User shall conduct an examination and lodge a complaint directly with the Operator, and shall take no action which would cause KBank to be responsible for the problem and damage.
- The User agrees and accepts that through the YouTrip Service, KBank and/or the Operator shall only facilitate purchase of goods/services and/or acceptance of payment for goods/services, or conduct transactions per the User’s instruction. KBank and/or the Operator have no involvement with the contract, terms or rights and duties agreed upon by the User and the seller of goods/services. If the User has a problem in the use of goods/services, or there is any defect of goods/services, or there is any dispute between the User and the seller of goods/services, whether it involves overdue payment, partial payment, suspended delivery of goods or services or any other case, the User shall be responsible for, and/or contact the seller of goods/services for, solving the problem/dispute by themself.
- Suspension of the Funds Transfer Tool, Suspension/Change/Termination of Service or in case of Errors
- The User may suspend the use of the Funds Transfer Tool or the YouTrip Service by contacting the Operator via the YouTrip Contact Center Number, 24 hours a day, per the procedures determined by the Operator, and the Operator shall proceed to suspend the use of the Funds Transfer Tool or the YouTrip Service accordingly. In addition, the User may suspend the YouTrip Service directly via the YouTrip application per the procedures specified in the YouTrip application.
- If the User finds any error in funds transfer/payment/cash withdrawal, or if there is any reason to temporarily suspend an operation under the YouTrip Service, either in whole or in part, or in the case that such an operation is to be unheld, the User may contact the Operator via the YouTrip Contact Center Number, 24 hours a day. After the User has completely performed operations per the procedures determined by the Operator, the Operator shall proceed to suspend/unhold the operation within the deadline that the Operator has stated to the User. The User shall continue to be liable for operations and transactions undertaken prior to the deadline that the Operator has stated to the User. KBank and/or the Operator reserve the right to disregard any request that is contrary to related regulations and laws (per the definitions specified below).
- If the User finds any error in funds transfer/payment/cash withdrawal, or if there is any reason to suspend an operation under the YouTrip Service, the User must present to KBank and/or the Operator information of the date, time, related parties, transaction amount and details, as well as other information that KBank and/or the Operator may request. KBank and/or the Operator shall complete the investigation and rectify any error (if any) (in compliance with the rules and regulations of the government and/or the Bank of Thailand and/or KBank and/or the Operator) within 30 (thirty) days of receiving all of the required information, and shall notify the User of such investigation results within 7 (seven) days of knowing them. If KBank and/or the Operator does not receive cooperation from the User, KBank and/or the Operator reserves the right to not be liable for any damages that have occurred. If there is any error for which KBank and/or the Operator has to compensate the User, KBank and/or the Operator shall credit the funds in question into the User’s deposit account/YouTrip Wallet within 7 (seven) days from when the error is confirmed by the KBank and/or the Operator.
- If there is an error in deducting an amount from or transferring an amount to the User’s YouTrip Wallet, which has not been caused by KBank and/or the Operator, the User shall examine and claim such an amount directly from the party to the dispute or repay such an amount directly to the party to the dispute. If the User has any defense and/or right to claim, the User shall contact the party to the dispute, directly and separately.
- Unless the Conditions for Use of the Service state otherwise, KBank is entitled to suspend the provision of service and terminate the YouTrip Service, either in whole or in part, or for any particular User, at any time. KBank shall notify the User of such a decision in advance. Regarding the following incidents, the User agrees that it is at KBank’s discretion to consider suspending and/or changing and/or terminating the service immediately, either in whole or in part, as KBank deems appropriate:
- The User has provided any inaccurate or untruthful information, details, certifications or confirmations, or they may cause material misunderstanding.
- The YouTrip Card has expired, and there is no renewal/issuance of a new YouTrip Card.
- There is factual information that leads KBank to believe that the information and/or details that the User has given to KBank in order to proceed with the launch or the use of this service by the User may cause negative impacts upon or affect the rights of KBank or the third party, or it is detrimental to public order and morality, or bears an unlawful intention.
- The User has breached any item of the Conditions for Use of the Service, including failure to pay for fees, service charges, penalty fees and other expenses.
- In the event of the User’s death or being officially deemed as incompetent or quasi-incompetent, or the User has been sued in a bankruptcy case or put under receivership, or there is a request for business rehabilitation, or the User is prohibited from undertaking financial transactions, in accordance with the relevant laws.
- KBank has examined the information and found that the User is on the UN/Thailand Sanction List.
- KBank has examined the information and found that the User forged documents and/or deliberately used someone else’s identity, either with or without that person’s consent, to apply for the YouTrip Service. In this case, the User must be liable for damages (if any) to KBank in all respects, whether or not the User intended to commit fraud.
- KBank cannot deduct funds from the User’s YouTrip Wallet for refund/compensation/debt, fee and expense payments to KBank, and/or to have KBank provide service in accordance with the User’s instruction.
- If KBank suspects that the YouTrip Card will be used by another person for fraudulent purposes, KBank shall terminate the YouTrip Card immediately for the security of the User. KBank shall then issue a new YouTrip Card to the User and notify the User accordingly.
- KBank shall act in compliance with the policies, rules, regulations, orders, provisions of the laws or legally competent agencies or supervisory agencies of KBank.
- KBank suspects that the use of the YouTrip Wallet is for commercial purposes or foreign exchange speculation, or is related to money laundering, terrorism or trade in weapons of mass destruction or for other purposes that are contrary to policies, rules, regulations, orders, provisions of the laws or supervisory agencies of KBank.
- The User gives notice of the cancellation of/change in the mobile phone number registered when applying for the YouTrip Service.
- If the User wishes to terminate the YouTrip Service, the User is required to first exchange all money in the YouTrip Wallet for Thai Baht, and ensure that there is zero balance in Thai Baht in the User’s YouTrip Wallet before terminating the YouTrip Service. The User can give notice of their intent to terminate the YouTrip Service via the YouTrip Contact Center Number, 24 hours a day, and KBank shall proceed to terminate the YouTrip Service in accordance with the User’s request, as soon as possible. If there are remaining funds in the User’s YouTrip Wallet, KBank shall return such funds to the User after deducting debt or fees or any expenses that the User has not paid to KBank (if any), by crediting the User’s deposit account held with the KBank as informed by the User, within a period specified by regulatory agencies.
- Warranty of the User
- The User certifies that the User is the ultimate beneficiary of the YouTrip Service. The User has an intent to establish relations with KBank, i.e., applying for the YouTrip Service and requesting KBank to issue the YouTrip Card to the User for payment of goods/services at home and abroad, or cash withdrawal abroad.
- In compliance with the regulations of the Anti-Money Laundering Office (AMLO) concerning the use of the YouTrip Service, the User certifies that the User’s income sources are from the following: ● savings ● self-employment/trading ● employment/salary ● returns from instruments/funds ● sales of securities/investment units ● remunerations from providing services ● inheritance/gifts. If KBank or legally competent agencies request additional information or documents related to the User’s income sources, the User agrees to provide additional information and documents as requested.
- The User certifies that the User will not use the YouTrip Service to conduct financial transactions having illegal purposes, including gambling, sex trade, money laundering, terrorism, trade in weapons of mass destruction, as well as actions that are detrimental to public order and morality, or violating intellectual property rights of other persons or other laws.
- The User certifies that any documents, information, details herein and/or that have been sent to KBank in any format, either by the User or the person designated by the User, are complete, true and up-to-date, and can be used by KBank to offer services and update information in KBank’s system. The User has the right and is legally competent to apply for the YouTrip Service and conduct any transaction related to the YouTrip Card Service, without the need for KBank to examine them again.
- Fee/service charge/expenses/penalty fee/tax
- The User agrees to make payment for service use, whether such payment is called the fee, service charge or by any other name, to KBank within the related deadline. If the User fails to make such payment within the deadline, the User agrees to make such payment to KBank immediately.
- The User agrees to be solely responsible for the fees, taxes and expenses related to the service (if any).
If KBank has to make advance payment of the fees, taxes and/or expenses per the previous paragraph in place of the User, the User agrees to make repayment to KBank immediately.
- Other Agreements and Conditions
- If the User wishes to correct any information and/or details, the User is required to notify KBank in writing or per the procedures determined by KBank.
- Changes in conditions of service
- If the change in conditions of service causes the User to incur more burden or risk, such a change shall become effective upon the User’s consent.
- If other conditions are to be changed, the User agrees to authorize KBank to make the change as it deems appropriate. If the change affects the User’s use of the service (such as adjustment of service fees to reflect rising costs, change to service channels, change to due date), KBank shall expressly communicate, or give notice of, material information of the change of the User at least 30 days in advance or within the period required by law.
- If KBank is required by relevant laws and/or regulations to proceed with a change in other specific condition, the User agrees to authorize KBank to act in compliance therewith.
- Collection, use or disclosure of information
The User agrees to allow KBank to collect and use the information of the User provided to or via KBank or held by KBank or that KBank has received or obtained from other sources for the purpose of providing services to the User, undertaking operations per the User’s request prior to service provision, assigning work to another person to support the services regarding IT, communications, collection or any other tasks, transferring rights and/or duties, legal compliance, risk management, audit, internal management, compliant handling, and/or for other purposes necessary for the significant operations of KBank or to allow KBank to continue to provide services with fairness. The User agrees to allow KBank to disclose such information to KASIKORNBANK FINANCIAL CONGLOMERATE, external service providers, KBank’s agents, subcontractors, co-branding partners, data processors, auditors, external inspectors, credit information companies, credit rating companies, asset management companies, prospective assignees, assignees, competent authorities, and/or any agencies/organizations/juristic persons having entered into a contract with KBank. The User also agrees to authorize such recipients of information from KBank to collect, use and disclose such information under said purposes, and send and/or transfer such information to keep on a server/cloud in other countries. Other details and rights are shown in the privacy policy page of KBank website: www.kasikornbank.com/en/privacy-policy. - KBank has the right to transfer the rights and/or benefits and/or duties, either in whole or in part, under the Conditions for Use of the Service to any individual and/or financial institution, as KBank deems appropriate, without the consent of the User, and shall inform the User of the transfer for acknowledgement. Nonetheless, the User shall not transfer the rights and/or benefits and/or duties, either in whole or in part, under the Conditions for Use of the Service to any individual and/or financial institution.
- In case of force majeure or any other causes that prevent KBank and/or the Operator from providing the services, the User agrees that it shall be at the discretion of KBank and/or the Operator to provide the services or take any action as they deem appropriate. The User agrees to fully cooperate with KBank and/or the Operator in every way as requested by KBank and/or the Operator to improve the service method of KBank and/or the Operator for the convenience of the User in using the services.
- The User agrees that KBank is entitled to set aside or deduct funds from the User’s YouTrip Wallet and/or the User’s deposit account at KBank in order to conduct transactions and/or take actions in accordance with the Conditions for Use of the Service and for payment of the User’s debt and/or liabilities held with KBank, without informing the User. The User shall not cancel or revoke this authorization until the YouTrip Wallet service is terminated.
- Any letter, notice, or information which KBank has sent to the User per the address given to KBank, whether by hand or by postal mail, either registered or unregistered, or email or SMS to the email address or the mobile phone number given to KBank, or via the services/channels earlier agreed upon by the User with KBank (the “Channel for Receiving Information”), shall be deemed as having been rightfully sent to the User, regardless of whether or not such a letter, notice or information is received; even though it cannot be delivered due to the relocation or demolition of, or change in, the Channel for Receiving Information, without any notification of the relocation, change or demolition given to KBank; or such a letter, notice or information cannot be sent because the Channel for Receiving Information cannot be located, it shall be deemed that the User has rightfully received the letter, notice or information, and acknowledged its content. In case of any relocation or demolition of, or change in, the Channel for Receiving Information, the User shall immediately inform KBank of the change in writing.
- The User agrees that KBank and the User shall be subject to laws, rules, regulations, directives, handbooks, request for cooperation and any criteria of the Bank of Thailand, courts of laws, regulatory agencies and other competent authorities, currently existing and to exist in the future (hereinafter collectively referred to as the “Relevant Laws and Regulations”). In case of change in the Relevant Laws and Regulations, the User agrees to comply with the Relevant Laws and Regulations so changed immediately after being notified by KBank. If the User fails to comply therewith and such non compliance has resulted in a penalty fee, damages and/or other expenses collected from KBank, the User agrees to be immediately responsible for such penalty fee, damages and/or other expenses.
- Any delays or exemptions in exercising rights under the law or the Conditions for Use of the Service, including handbooks and KBank’s IVR system, shall not be regarded as KBank’s relinquishing such rights or as KBank’s giving the User consent to perform any act.
- Whenever the terms and conditions for the use of the YouTrip Service as specified in the Conditions for Use of the Service or those of other related services become void, illegitimate, invalid or unenforceable, the other remaining terms and conditions (as the case may be) shall remain legally valid and enforceable; they shall not be affected by voidability, illegitimacy, invalidity or unenforceability of those terms and conditions.
- The Conditions for Use of the Service shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, and the courts of Thailand shall have exclusive jurisdiction to adjudicate any dispute arising under or in connection with the Conditions for Use of the Service.
