Terms and Conditions for Linking and Using YouTrip Card through Digital Wallet Service

The YouTrip User (the “User”) of KASIKORNBANK PUBLIC COMPANY LIMITED (the “Bank”) agrees to link and use the YouTrip Card through the digital wallet service of an external digital wallet service provider. The User agrees to be bound by and comply with the following terms and conditions for linking and using YouTrip Card through the digital wallet service (this “Terms and Conditions”), and agrees that this Terms and Conditions shall be deemed an integral part of the Terms and Conditions for Using YouTrip Service that the User has agreed with the Bank.

  1. Digital Wallet Service is the Service of the Digital Wallet Service Provider

1.1 The User understands and acknowledges that the digital wallet service (theDigital Wallet Service“) is operated by an external digital wallet service provider (the “Digital Wallet Service Provider”) to facilitate the User’s use of YouTrip Card to pay for goods and/or services in lieu of cash by making transactions through the Digital Wallet Service on a mobile phone or any other device as determined by the Digital Wallet Service Provider (the “Smart Device“).

1.2 The User acknowledges and agrees that the Bank has no involvement in providing the Digital Wallet Service or the Merchant (as defined below). In case the User has any problems or questions about the Digital Wallet Service, the User can contact the Digital Wallet Service Provider and/or the Merchant (as the case may be). In case the User has any problems or questions about the YouTrip Card, the User can contact You Technologies Group (Thailand) Co., Ltd., which is the YouTrip application service provider and issues the YouTrip Card in collaboration with the Bank, via the YouTrip Contact Center.

The Merchant means stores that accept payment for goods/services with the YouTrip Card through the Digital Wallet Service as determined by the Digital Wallet Service Provider.

2. Registration of the YouTrip Card with Digital Wallet Service

2.1 The User must be the owner of the YouTrip Card that the information contained therein will be linked with the Digital Wallet Service for registration.

2.2 The User must have a Smart Device that is compatible with the Digital Wallet Service and shall install/register the Digital Wallet Service application on the Smart Device in accordance with the details of the installation/registration procedures for the Digital Wallet Service as determined by the Digital Wallet Service Provider.

2.3 Adding Information/Linking YouTrip Card

1) In case using the Digital Wallet Service application

The User shall add information/link the YouTrip Card on the Digital Wallet Service application in accordance with the steps and procedures as determined by the Digital Wallet Service Provider. The User shall successfully verify and authenticate their identity by using the OTP (One-Time Password) received from YouTrip via the mobile phone number or email that the User has registered with YouTrip service, or by any other method as determined by the Bank.

2)  Via the YouTrip application

The User shall connect to the Digital Wallet Service application to add information/link the YouTrip Card on the Digital Wallet Service application in accordance with the steps and procedures as determined by the Digital Wallet Service Provider. The User shall successfully verify and authenticate their identity by using the OTP (One-Time Password) received from YouTrip via the mobile phone number or email that the User has registered with YouTrip service, or by any other method as determined by the Bank.

The User agrees and confirms that the information used for linking the YouTrip Card and/or for registering the Digital Wallet Service is accurate, true, and consistent with the information provided to the Bank for the use of the YouTrip Card.

2.4 The User shall keep confidential any personal identification code related to the use of the YouTrip Card through the Digital Wallet Service, such as the YouTrip Card number, Username, and Password or PIN of Smart Device and Digital Wallet Service, and shall not disclose it or take any action that may allow others to know and/or access the use of the Digital Wallet Service and/or Smart Device and/or use the User’s YouTrip Card.

2.5 In case the Bank issues a new YouTrip Card to the User and/or there is a change in the YouTrip Card number, if the User wishes to use the new YouTrip Card through the Digital Wallet Service, the User shall add information/link the new YouTrip Card, including verifying and authenticating their identity in accordance with the steps and procedures as determined by the Digital Wallet Service Provider. The User agrees that the new YouTrip Card shall also be considered the YouTrip Card per the definition under this Terms and Conditions.

3. Use of the Virtual Card to Pay for Goods/Services through the Digital Wallet Service

3.1 The User may use the YouTrip Card, which has been added/linked to the Digital Wallet Service application (theVirtual Card”) to pay for goods/services through the Digital Wallet Service with the Merchant by tapping the Smart Device containing the YouTrip Card information on a contactless payment reader or by any other method as determined by the Digital Wallet Service Provider.

The User agrees and accepts that any transaction made by using the Virtual Card via the Digital Wallet Service, utilizing the User’s personal identification code and/or Smart Device, whether by the User themself or by any other person, shall be deemed correct and valid, and to be binding as if it were made by the User themself in all respects. The User shall not be required to sign any additional document/agreement, and the User shall be responsible for settling payments for such YouTrip Card transaction.

3.2 Transactions made using the Virtual Card to pay for goods/services through the Digital Wallet Service are considered to be the same as those using the YouTrip Card via another channel and will be charged to the YouTrip Wallet. The User agrees to be bound by the use of the Virtual Card in accordance with the Terms and Conditions for Using YouTrip Service that the User has agreed with the Bank in all respects.

3.3 The User agrees and acknowledges that the benefits that the User will receive from using the Virtual Card through the Digital Wallet Service to pay for goods/services may differ from the benefits from the use of the YouTrip Card via other channels.

3.4 The User agrees and acknowledges that in the event that any personal identification code set by the Digital Wallet Service Provider for identity verification before payment for goods and/or services with the YouTrip Card through the Digital Wallet Service is temporarily or permanently suspended due to incorrect login attempts, incorrect personal identification code entry, or any other reason which causes the personal identification code to be suspended, the User will not be able to use the Virtual Card through the Digital Wallet Service. The User agrees to not cite the aforementioned reasons as grounds for claiming any damages that may arise from the suspension of such transactions with the Bank and/or You Technologies Group (Thailand) Co., Ltd.

3.5 In the event that the computer system, the Smart Device, data transmission process, the internet system, or any other system related to the use of the YouTrip Card via the Digital Wallet Service is disrupted or damaged or under repair or temporarily closed for maintenance, or affected by any other force majeure event, which prevents the User from using the Virtual Card to make payment for goods and/or services in lieu of cash through the Digital Wallet Service, the User agrees and acknowledges that they shall in no way hold the Bank responsible for any such disruptions.

4. Cancellation and Suspension of the Virtual Card Linked to the Digital Wallet Service

4.1 The User agrees and acknowledges that in the event that the User wishes to cancel the linking of the YouTrip Card/remove the YouTrip Card information from the Digital Wallet Service, or if the User no longer uses the Smart Device in which the Virtual Card was registered, the User is responsible for deleting/removing the YouTrip Card information from the Smart Device through the Digital Wallet Service application, in accordance with the steps and procedures as determined by the Digital Wallet Service Provider.

4.2 The User agrees that the Bank may withhold and/or cancel the linking of the YouTrip Card / the use of the Virtual Card, at any time, either in whole or in part, or those given to any one of the users, with prior notice. Except for the following cases, for which the User agrees that the Bank may withhold and/or cancel the linking of the YouTrip Card / the use of the Virtual Card, either entirely or partially, immediately, as the Bank deems appropriate, without informing the User in advance, and the Bank shall not be responsible for any damage which may arise therefrom.

4.2.1 Any data, details, warranty or confirmation provided by the User is not true or not accurate, or may cause material misunderstanding.

4.2.2 The YouTrip Card has expired, and there is no renewal/issuance of a new YouTrip Card.

4.2.3 A fact comes to light that convinces the Bank that data and/or details provided by the User to the Bank for operations or the linking of the YouTrip Card / the use of the Virtual Card may have adverse consequences, or may affect the rights of the Bank or another person, or it is contrary to public order or morality, or may cause the Bank to violate laws and regulations.

4.2.4 A fact comes to light that convinces the Bank that the User’s personal identification code has been disclosed or divulged to another person, or another person can access or use it.

4.2.5 A fact comes to light that convinces the Bank that the linking of the YouTrip Card / the use of the Virtual Card by the User is inappropriate according to purposes of the Bank’s services.

4.2.6 The Bank found that the User is on UN/Thailand Sanction List.

4.2.7 The Bank found that the User has falsified documents and/or assumed another person’s identity, whether or not that person has given consent for such action, for the linking of the YouTrip Card / the use of the Virtual Card, regardless of whether or not the User intends to commit fraud.

4.2.8 The Smart Device has been modified or it is found that the mobile phone network system and/or any other related component and risk incurred may cause damage to the User and/or the linking of the YouTrip Card / the use of the Virtual Card.

4.2.9 The User fails to comply with one of this Terms and Conditions or the Terms and Conditions for Using YouTrip Service.

4.2.10 The Bank cannot deduct funds from the User’s YouTrip Wallet for refund/compensation/debt, fee and expense payments to the Bank, and/or to have the Bank provide service in accordance with the User’s instruction.

4.2.11 The User dies.

4.2.12 The Bank shall comply with related laws and regulations.

4.2.13 The User gives notice of the cancellation of/change in the mobile phone number registered when applying for the YouTrip Service.

4.3 The termination of the use of the YouTrip Card, for whatever reason, shall be considered as the termination of the Virtual Card under this Terms and Conditions in all respects.

5. Personal Data Protection

The User agrees and consents to the Bank to collect and use any of their personal data and/or information for the purpose of (i) providing services, (ii) fulfilling the request of the User before providing the services, (iii) assigning third parties to support the services, such as information technology, communications and collection, (iv) assignment of rights and/or obligations and/or (v) solving complaints. The User further agrees and consents to the Bank to disclose their personal data and/or information, whether in or outside the country, to outsourcing service providers, the Bank’s agents, sub-contractors, co-branding alliances, prospective assignees, assignees and/or cloud computing service providers, and also agrees and gives consent to the aforementioned parties to collect, use and/or disclose their personal data and/or information for the same purposes. In the event that the User discloses another person’s personal data to the Bank for the aforementioned purposes, the User represents and warrants to the Bank that the User has obtained consent from such person or has a legal basis to disclose such person’s personal data to the Bank and has informed such person of the details of the collection, use and/or disclosure of personal data pursuant to the aforementioned Privacy Policy.

6. Change or Addition to this Terms and Conditions

6.1 If the change in conditions for service use causes the User to incur more burden or risk, such a change shall require prior consent from the User.

6.2  If other conditions are to be changed, the User agrees to authorize the Bank to make the change as it deems appropriate. If the change affects the User’s use of the service, the Bank shall expressly communicate, or give notice of, material information of the change to the User at least 30 days in advance or within the period required by law.

6.3 If the Bank is required by law and/or rules and regulations to proceed with change in other specific conditions, the User agrees to authorize the Bank to act in compliance with the law and/or rules and regulations.
